Terms of Service

Updated October 23, 2026

The short version

  • We provide software that connects your watch app to your own Stripe or PayPal account. We are not the seller, not a payment processor, and we never hold your money.
  • You are the seller. Your product, prices, refund policy, taxes, consumer-law duties and buyer support are yours.
  • You pay a yearly plan: Starter $9, Pro $99 or Studio $299, each with sales included, then 2% above. You can move up at any time and down at renewal.
  • Extras are optional: $15 a month per studio for export to phone, reviews and replies, watch statistics and data feeds. Data feeds also cost $2 for each million requests from live watches and live keys.
  • You can give a watch Premium free, up to 25 live watches in 30 days. A gift is not a sale and carries no fee, and it must never stand in for a payment taken elsewhere.
  • If we suspend your account, new checkouts stop, but watches your buyers paid for stay unlocked whenever the law allows.
  • If we ever close, you get 90 days' notice and your records, and every paid watch is told it is paid for good.
  • We give you 30 days' notice before we change these terms or our fees.

1. Who we are

WearCheckout provides a hosted service that lets developers sell paid features in their Garmin watch apps, watch faces and data fields through their own payment account. In these terms, "WearCheckout", "we", "us" and "our" mean WearCheckout, the provider of the service. "You" means the person or business that creates a WearCheckout account.

These terms are a binding agreement between you and us. They apply whenever you use the service. Our Privacy Policy explains how we handle personal data.

How to reach us: Message support under Help in your dashboard, or contact@wearcheckout.com for anything, including privacy requests and security problems.

WearCheckout is not affiliated with or endorsed by Garmin. Garmin and the names of its products are trademarks of Garmin Ltd. or its subsidiaries.

2. Words we use

  • Service: everything we provide, including the dashboard, the watch library, the servers that answer watches, the pay pages, statistics, the emails we send and our documentation at /docs/.
  • App: a watch app, widget, watch face or data field that you publish for Garmin watches and connect to the service.
  • Watch library: the code you add to your app. It asks our servers whether a watch has paid, and draws the buy screens and the unlock.
  • Buyer: anyone who uses one of your apps, or buys from you through the service.
  • Processor: the payment company whose account you connect, such as Stripe or PayPal.
  • Pay pages: the web pages we host for your buyers, such as the link in the watch's QR code, the confirmation page after paying, and the pages for exports, withdrawals, feedback and moving a purchase to a new watch.
  • Sales: what your buyers pay for your apps through the service in live mode, counted as section 7 says.
  • Your content: the names, icons, colors, texts, prices and links you give us for your apps.
  • Team member: a person you let use your account.
  • Extras: the optional paid parts in section 7: export to phone, reviews and replies, watch statistics, and data feeds.
  • Data feeds: answers such as weather, sun and moon times, prayer times, tides, earthquakes, aurora, holidays, exchange rates and world clocks, which your app or your server asks us for.

3. Who can use WearCheckout

To open and keep an account, you must meet all of these conditions:

  • You are at least 18 years old and able to make a binding contract.
  • You tell us truthfully whether you use the service as a business or as an individual, and you give us your correct country and business details. We rely on them to work out tax on our fees. You keep them up to date.
  • If you accept these terms for a business, you have authority to bind it. "You" then means that business.
  • You are not located, organized or ordinarily resident in a country or region under comprehensive sanctions.
  • You are not named on a government sanctions list, such as the US Treasury's Specially Designated Nationals list or the consolidated lists of the European Union, the United Kingdom or the United Nations. You are not owned or controlled by anyone who is. We check developers against sanctions lists when they sign up and every month after that.
  • Before any of your apps takes a live payment, you complete Garmin's trader verification. You keep your store listings accurate.

We may refuse an account, or ask you for more information, when we can't confirm these conditions.

4. What WearCheckout is, and what it isn't

What we do

We provide software. You connect your own processor account, add the watch library to your app, and set your prices in the dashboard. When a buyer scans the QR code on the watch, or opens its buy link, we send them to your processor's own hosted checkout. When your processor tells us a payment went through, our servers tell the watch to unlock. When your processor tells us about a refund or a lost dispute, the watch locks again at its next check.

What we are not

  • We are not the seller. You are the seller in every sale. Your name appears as the seller on the pay pages.
  • We are not a payment processor, a bank or a money transmitter. We never receive, hold, move or pay out buyers' money. Buyers pay into your processor account, and your processor pays you.
  • We never see card details. Buyers enter them only on your processor's own pages.
  • We are not part of your contract with your processor. You contract with your processor directly, on its terms. Its decisions about your account are its own, including verification, payouts, holds, refunds, disputes and its fees. We can't change them.

Your processor connection

  • Stripe. Connecting Stripe creates a Stripe account in your name, connected to our Stripe platform. You sign in to it with your own Stripe login, and you see everything in your own Stripe dashboard. Stripe charges its fees to you.
  • PayPal. You give us the credentials of your own PayPal REST app. We store the secret encrypted with our own keys.
  • Through the connection, we can create checkouts on your account and read the payments, refunds, disputes and subscriptions they produce. We use this access only to run the service for you. We create a refund on your account only when you ask us to.
  • You can disconnect a processor at any time in the dashboard. New checkouts through it then stop.

Garmin and the services we depend on

The service depends on Garmin's watches, the Garmin Connect app, Garmin's app store and your processor. We don't control them. If Garmin or a processor changes its rules or systems, we may have to change or stop part of the service. We will tell you as soon as we reasonably can.

Test mode

Test mode is free. Test payments run in your processor's test environment and move no money. A test watch your studio has claimed has every extra, free.

Moving from another service

  • You can import your past payments from your Stripe or PayPal connection, or from a file. We use them to show your history and to recognise watches that have already paid.
  • For each app, you choose whether watches that paid on your old service stay unlocked after your update. You can have us check each watch with your old service, trust what the watch says for up to 90 days, or unlock every watch that asks before a date you set. You can lock carried-over watches again at any time.
  • When you give us your old app's ID at KiezelPay or PayToUse, we ask that service whether each watch has paid, using what your app sends from the watch. You confirm that your agreement with that service allows it. Unlocking watches on trust is your choice, at your own risk.

Giving Premium free

  • An admin on your team can give one watch your app's paid features free, from that watch's page in the dashboard, after confirming it's them with two-step sign-in. The watch unlocks at its next check, with no payment.
  • You can take it back at any time. The watch locks again the next time your app opens on it.
  • In live mode, you can give Premium free to up to 25 watches in any 30 days, whether or not you take it back later. Message support if you need more. Test watches have no limit.
  • We record each gift and each take-back, with who made it and when. You see them on the watch's timeline.

Your apps on Garmin's app store

For each app you link to its listing, we read the listing's public page once a day, and again when you open the Store page (at most every 10 minutes): its rating, reviews, downloads and version. We read only your own apps' listings.

Data feeds

  • We work out some answers ourselves: sun and moon, prayer times, world clocks, and exchange rates from the European Central Bank's reference rates. Others we pass on from public sources: MET Norway (weather), the US National Weather Service (alerts), the US Geological Survey (earthquakes), NOAA (aurora and US tides) and Nager.Date (public holidays).
  • We provide data feeds as they are. We don't promise that an answer is accurate, complete or on time. Don't rely on them where a wrong answer could hurt someone, such as for navigation, safety outdoors or at sea, or medical decisions.
  • Where a source asks for credit, you show it in your app, as our docs say. For weather, that is "Weather: MET Norway".
  • We may change or remove a source when it changes its terms or stops. We tell you as soon as we reasonably can.

Built-in protections

  • We block sign-ups and pay pages from countries and regions under comprehensive sanctions. Buyers there can't buy through the service.
  • To stop card testing (criminals trying stolen cards), we limit how many checkouts can be opened. We may pause an app's checkouts automatically when its declines spike. We tell you when that happens.
  • A watch that has paid keeps its paid features for 30 days after our last answer, even if it can't reach us. After that they pause until the watch reaches us again.

5. Your account

  • You sign in with a passkey, or with a one-time link we email to you. You can add 2-step sign-in with physical security keys, with 10 one-time recovery codes as a backup.
  • Keep your email account, passkeys, security keys and recovery codes safe. Anyone who controls them can control your account.
  • You are responsible for what happens in your account, including what your team members do.
  • Tell us at once at contact@wearcheckout.com if you think someone else has got into your account.
  • API keys and webhook endpoints you create act for your studio. Keep keys secret, and revoke a key at once if it may have leaked. We log each API call for 30 days and show the log to you.
  • Before sensitive actions, we may ask you to sign in again. These include connecting a processor, changing a price, taking an app live, exporting data and deleting your account.
  • We send you service emails, such as sign-in links, alerts, statements and notices of changes. They are part of the service, so you receive them while you have an account. We won't send you marketing email without your consent.

6. Your duties as the seller

You are the seller. You are responsible for:

  • Your product. Your apps, what they do, and that paid features work as you describe them.
  • Your seller terms, refund policy and privacy notice. You publish them and give us their links. We show them to buyers on the pay pages. Your privacy notice must tell buyers that their data goes to you, and to us as your service provider, not to Garmin.
  • Consumer law where you sell. We give you tools to help: a consent step for EU buyers who want immediate access, a way to send the confirmation EU law requires, a withdrawal page for EU buyers, renewal consent and a cancel link for subscriptions, and starter wording. You choose the final words. Meeting the law is your responsibility.
  • Taxes on your sales. Sales tax, VAT and other taxes on what your buyers pay are yours to charge, report and pay. Your processor may offer tools for this. We don't calculate or collect tax on your sales.
  • Buyer support. You answer your buyers' questions, refund requests and complaints. Your support email appears on the pay pages. If a buyer writes to us, we point them to you.
  • Refunds and disputes. You handle them in your processor's dashboard, at your cost. Your processor's dispute fees are yours.
  • Garmin's rules. You follow Garmin's developer agreement and app review guidelines. Today they include: completing trader verification; marking your listing as requiring payment when any primary feature costs money; saying from the outset what is free and what is paid; stating a refund policy; getting consent for automatic renewal; no bait-and-switch; and no paywall over the time on a watch face. Garmin's current rules bind you, not our summary of them.
  • Your processor's rules. You follow your processor's terms, including its rules on what you may sell.
  • Accurate information. What you show buyers, on the watch, on the pay pages and in your listing, must be true and complete.

Before an app goes live

Before an app takes live payments, you must:

  1. complete Garmin's trader verification;
  2. mark the app's listing as requiring payment, where Garmin's rules require it;
  3. complete a test purchase on a watch;
  4. give us a seller name and a support email;
  5. give us links to your seller terms, refund policy and privacy notice; and
  6. connect a live processor account.

Apps for children

If any of your apps is directed at children, or you know that a user is a child, you must tell us before the app goes live. A child means anyone under 13 in the US, or under the age of digital consent where you sell (between 13 and 16 in the EU). You are then responsible for the Children's Online Privacy Protection Act (COPPA) in the US, Article 8 of the GDPR and similar laws, including any notice to parents and any consent they must give. The service is not designed for children.

7. Fees

Plans

You pay us a yearly plan. We take no fee from a sale your plan covers.

PlanPrice a yearSales included a yearSales above thatPaid appsSubscriptions and offers
Starter$9$1,0002%3No
Pro$99$10,0002%5Yes
Studio$299$50,0002%UnlimitedYes
  • Prices are in US dollars.
  • Test mode is free. Your plan starts when your first app goes live.
  • Plans are paid yearly in advance. They renew each year until you cancel or delete your account.

How we count your sales

  • We count your sales over the last 12 months, from your processor's own records.
  • We count the full amount your buyers pay, before your processor's fees.
  • We convert other currencies to US dollars at the European Central Bank's reference rate for the day of the sale.
  • Refunds and lost disputes come off your sales.
  • Premium you give free is not a sale. It adds nothing to your sales, and we take no fee for it.

Your plan and moving plans

  • You choose your plan. For each plan year you pay its price, plus 2% of your sales above what it includes.
  • You can move to a bigger plan at any time. The move takes effect at once. We charge the difference between the two plans' yearly prices, and your renewal date stays the same.
  • A move to a smaller plan takes effect at your next renewal. We don't refund the difference for the rest of the plan year.
  • On Starter, a fourth paid app can't go live until you move to Pro or Studio.

Going over

  • Going over your plan's included sales never stops a sale.
  • When you reach 80% of your plan's included sales, we email you. We show the projected cost, and whether a bigger plan would cost less.
  • Above the included sales, we charge 2% of the sales above them. We bill this monthly once it reaches $10. Smaller amounts wait for the next bill.
  • We never charge the 2% twice on the same sale.

Extras

  • Extras are optional. They cost $15 a month per studio, for all four parts together: export to phone, reviews and replies, watch statistics, and data feeds. No plan includes them.
  • You can turn them on once your plan's first bill is paid. They start at once, the first month is billed at once, and they renew every month.
  • You can turn them off at any time. They stop at once on every live watch. We don't refund the rest of the month.

Data feeds

  • Data feeds need Extras on. On top of Extras, they cost $2 for each million answered requests from live watches and live API keys.
  • We count by calendar month, in UTC. On the 1st of the next month, we add the month's total to your next bill as one line, rounded to the nearest cent.
  • Requests from test watches and test keys are free, and so are requests we refuse.
  • The Data feeds page in your dashboard shows this month's requests and their cost so far.

Your processor's fees

Your processor's own fees are separate from ours. Your processor charges them to you directly.

Paying us

  • We bill you through Stripe, on our own Stripe account, using the payment method you give us. Card details go to Stripe, not to us.
  • Our prices don't include taxes. Where the law requires us to charge VAT, GST or sales tax on our fees, we add it to your invoice and show it separately. If you are a business with a valid VAT number, the reverse charge may apply instead.
  • Each month, the dashboard shows your statement, also as a CSV file: your sales, your plan, any 2% charge, and refunds.
  • If a payment to us fails, we try again and remind you by email on the day it fails and again after 3, 7 and 14 days. If it is still unpaid on day 15, new checkouts for your apps pause until you pay. Watches your buyers already paid for stay unlocked.

Refunds of our fees

  • If a sale is refunded or a dispute on it is lost after we charged 2% on it, we credit that charge on your next bill.
  • We don't refund a plan's price once its plan year has started, except in these cases: we end your account without cause; we close the service; you end the service because you objected to a new sub-processor (section 11); or the law gives you a right to a refund. In those cases, we refund the unused part of your plan year.

Changes to our fees

We may change our prices or plans. We tell you by email at least 30 days before a change takes effect. A change never applies to fees already billed. If you don't accept a change, you can cancel or delete your account before it takes effect.

8. What we do for you

  • Security. We protect the service and your data with reasonable technical and organizational measures. They include encryption in transit and at rest, our own extra encryption for processor secrets, one-way hashes for watch IDs, sign-in tokens and recovery codes, strict separation between developers' data, and pay pages that load no third-party scripts but Stripe's own payment form. Our Privacy Policy describes them.
  • Uptime. We use our best efforts to keep the service running and to fix problems fast. We post incidents on our status page.
  • No service level. We don't promise any level of availability, and we don't give credits for downtime. The service may be interrupted for maintenance, by failures of the services we depend on, or for reasons we can't foresee.
  • Alerts. We email you when something needs your attention, such as a processor connection that is failing.
  • Support. We answer support questions sent from Help in your dashboard or to contact@wearcheckout.com.

9. Acceptable use

You may use the service only to sell digital features of apps that you publish, or have the right to sell. You must not use the service, or let anyone use it, to:

  • sell or promote anything that is illegal where you or your buyers are;
  • offer gambling, or sexual or other adult content;
  • offer deceptive apps, or mislead buyers about what they get, the price, the renewal terms or what is free;
  • break Garmin's rules or your processor's rules;
  • post or buy fake reviews, or ask only satisfied users to review an app in the store;
  • give Premium free in return for a payment taken any other way, or use free Premium to get around checkout, your plan or its fees;
  • get around the limit on free Premium, such as by spreading gifts across several accounts;
  • give Premium free in return for a review, a rating or a download;
  • sell content you have no license for, or infringe anyone's intellectual property;
  • test stolen cards, commit fraud or launder money;
  • evade sanctions, including by hiding where you or your buyers are;
  • break into, overload, probe or disrupt the service, get around its limits or security, or reach data that isn't yours;
  • collect data about buyers or other developers beyond what the service gives you for your own apps; or
  • break any other law.

If you find a security vulnerability, report it to contact@wearcheckout.com. Give us reasonable time to fix it before you tell anyone else. Don't access more data than you need to show the problem.

If you break this section, we may suspend your account under section 10 or end this agreement under section 17.

10. Suspension

We may suspend all or part of your account if:

  • you break section 9 or another important part of these terms;
  • we reasonably suspect fraud, card testing or other abuse;
  • your apps have dispute or fraud rates high enough to put buyers, your processor account or the service at risk;
  • a law, court order, regulator or sanctions rule requires it;
  • your account is a security risk to the service or to buyers, for example after a suspected takeover; or
  • a payment to us is more than 14 days overdue. Then only new checkouts pause, as section 7 says.

What a suspension does

  • New checkouts for the affected apps stop.
  • Watches your buyers already paid for stay unlocked, whenever the law allows.
  • We tell you why, unless the law forbids it, or telling you would harm an investigation, buyers or the service. Where we can, we tell you before we suspend and give you a chance to fix the problem.
  • You can reply to our notice at contact@wearcheckout.com to explain or fix the problem. We lift the suspension once the reason is resolved.

11. Your buyers' data

For personal data about your buyers, you are the controller and we are your processor. The controller is the party that decides why and how personal data is used. The processor handles it on the controller's behalf. This section is our data processing agreement under Article 28 of the EU GDPR and the UK GDPR, and under similar laws. It forms part of these terms. For your own account data, we are the controller, as our Privacy Policy explains.

A fuller Data Processing Addendum is available on request at contact@wearcheckout.com. If we both sign it, it takes precedence over this section.

What we process for you

  • Purpose: to run the service for your apps. That means recognising watches, tying purchases to them, unlocking and locking features, running trials, creating checkouts on your processor account, keeping consent records, supporting you and your buyers, and showing you statistics.
  • Nature: collecting, storing, hashing, encrypting, matching, sending to your processor, and deleting.
  • Types of data: hashed watch IDs; watch codes; each watch's model, language and app version; purchase records (amounts, currency, status, processor IDs and times); consent records; a buyer's email, when your processor sends it and support needs it; messages buyers send through the pay pages, such as feedback and withdrawal requests; and IP addresses, for a short time.
  • People: your buyers and the users of your apps.
  • Duration: while you use the service, then as section 17 says.

Your duties as controller

You must have a legal basis for the processing you ask of us. You must tell your buyers about it in your privacy notice. Your instructions to us must comply with data protection law.

Our commitments to you

  1. Your instructions. We process your buyers' data only on your documented instructions. These terms, your dashboard settings and your written requests are your instructions. You instruct us to make counts that identify no one, to run and improve the service. If a law requires us to process the data in another way, we tell you first, unless that law forbids it. We tell you if we think an instruction breaks data protection law.
  2. Confidentiality. Everyone we allow to handle the data is bound to keep it confidential.
  3. Security. We take the measures that Article 32 of the GDPR requires. Our Privacy Policy lists them.
  4. Sub-processors. You authorise the sub-processors listed in our Privacy Policy. We give you at least 30 days' notice, by email and on that page, before we add or replace one. You may object on reasonable data protection grounds within that time. If we can't resolve your objection, you may end the service, and we refund the unused part of your plan year. We bind each sub-processor to data protection terms at least as strict as these, and we stay responsible to you for its work.
  5. Requests from buyers. We help you answer buyers who ask to see, correct, export or delete their data. We find their records by watch code or by your processor's payment ID. If a buyer asks us directly, we point them to you. We don't answer for you unless you ask us to.
  6. Assessments. We help you with data protection impact assessments and with consulting regulators, as far as the information we hold allows.
  7. Breaches. We tell you without undue delay after we learn of a personal data breach affecting your buyers' data, aiming for 72 hours. We tell you what happened, what data and roughly how many people are affected, the likely effects, what we are doing, and what you should rotate or do. We send updates as we learn more.
  8. Deletion or return. Before you delete an app or your account, you can export your data from the dashboard. We then delete your buyers' data as section 17 says, unless a law requires us to keep it.
  9. Audits. We show that we meet this section by answering your written security questionnaire, up to once a year, and by sharing our sub-processors' audit reports where they allow it. If that is not enough, or a regulator requires more, you may have an independent auditor bound by confidentiality audit us. You give us 30 days' notice, pay the cost, and audit no more than once a year.

International transfers

When your buyers' data moves from the European Economic Area to a country without an adequacy decision, the Standard Contractual Clauses approved by the European Commission in Decision (EU) 2021/914 apply between you, as data exporter, and us, as data importer. They form part of these terms. Module 2 applies where you are a controller, and Module 3 where you are a processor. For data from the UK, the UK International Data Transfer Addendum to those clauses applies. For data from Switzerland, the clauses apply with the changes Swiss law requires.

In those clauses: Clause 7 does not apply; Option 2 of Clause 9 applies, with the notice period in this section; the optional wording in Clause 11 does not apply; under Clauses 17 and 18, the law and courts of Ireland apply; and the annexes are completed from this section and our Privacy Policy. If the clauses conflict with these terms, the clauses win.

12. Intellectual property

Ours

We own the service, our servers and their code, our website, the dashboard, our documentation, and the WearCheckout name and logo. These terms let you use the service while you have an account. They give you no other rights in it.

The watch library

We publish the watch library under a permissive open-source license of the MIT kind. The license that comes with the library governs your use of its code. Where it differs from these terms, the license wins. The protocol between watches and servers is documented openly. Using our servers still requires an account under these terms.

Yours

You keep all rights in your apps and your content. You give us a worldwide, non-exclusive, royalty-free license to host, copy, resize, format and show your content on watch screens, pay pages, the dashboard and the messages we send for you, only to provide the service. The license lasts while you have an account, and after that only as far as we must keep records under section 17. You confirm that you have the rights to give us this license.

If someone tells us that your content infringes their rights, we may remove it or pause the affected pages. We tell you when we do.

Our name on your pages

Pay pages show a small "Payments by WearCheckout" line. It stays on every plan; only a custom plan agreed with us in writing can turn it off. You may say that your app uses WearCheckout. Any other use of our name or logo needs our written permission.

Feedback

If you send us ideas or feedback about the service, we may use them freely, with no duty to you.

13. The sunset promise

If we ever decide to close WearCheckout:

  1. We give you at least 90 days' notice by email.
  2. We give you an export of your records: purchases, watches (as hashed IDs) and watch codes.
  3. Before we shut down, our servers tell every watch that is paid at that time that it is paid for good. The watch library then never needs to check again, so your buyers keep what they paid for.
  4. The watch library accepts a fallback server address that you run. You can host the open protocol yourself and keep selling.

This promise binds anyone who takes over the service from us. It continues after this agreement ends.

14. No warranties

Apart from the promises these terms make, we provide the service "as is" and "as available". To the fullest extent the law allows, we give no other warranties or conditions, express or implied. That includes warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, and any warranty that the service will be uninterrupted, secure or free of errors.

We don't promise that Garmin will accept your apps, that a processor will accept or keep your account, or that you will make sales. We don't promise that every watch will unlock at once. Unlocking depends on the buyer's watch, phone, Bluetooth or Wi-Fi connection, the internet, Garmin's systems and your processor, which we don't control.

If you are a consumer, you keep any warranty rights that the law of your home country gives you and that can't be excluded.

15. Limits on our liability

  • To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, sales, data or goodwill, however caused, even if we were told they were possible.
  • Our total liability for all claims arising out of or relating to these terms or the service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.
  • These limits don't apply to: death or personal injury caused by our negligence; our fraud, gross negligence or wilful misconduct; or any other liability that the law doesn't allow us to limit or exclude. They don't reduce any refund these terms promise.
  • If you are a consumer, these limits apply only as far as the law of your home country allows.

16. Your indemnity

You will defend us, and the people who work for us, against any claim by a third party, and pay the resulting losses, damages, fines, settlements and reasonable legal costs, to the extent the claim arises out of:

  • your apps and what you sell;
  • your sales, refunds, disputes and buyer support, including any claim by a buyer;
  • your content;
  • taxes on your sales; or
  • your breach of these terms or of the law, including consumer law and the data protection duties you have as controller.

We will tell you promptly about the claim, let you control the defence, and help you reasonably, at your cost. You may not settle a claim in a way that admits fault for us or puts a duty on us without our written agreement. We may join the defence with our own lawyer, at our own cost.

17. Ending this agreement and deleting your account

If you leave

You can delete your account at any time in the dashboard. We ask you to sign in again and type a confirmation first. Deleting your account ends this agreement. We don't refund fees already billed, except as section 7 says.

If we end it

  • We may end this agreement at once, by email, if you seriously or repeatedly break these terms, if the law requires it, or if you don't fix the reason for a suspension within a reasonable time.
  • We may end it for any other reason with at least 90 days' notice. We then refund the unused part of your plan year.
  • If we close the whole service, section 13 applies.

What happens to your data

  1. Before your account is deleted, you can export your data from the dashboard.
  2. We disconnect your processors and delete their secrets at once.
  3. We delete your apps and their watch records.
  4. We keep purchase and fee records only as long as tax law requires, cut down to amounts and IDs.
  5. We confirm the deletion by email.

Copies in our backups are deleted within 30 days.

Your buyers' watches. Once an app's watch records are deleted, our servers can no longer answer that app's watches. A paid watch keeps its paid features for 30 days after our last answer, and then they pause. Before you delete an app or your account, tell your buyers. You remain responsible to them for what you promised.

What continues after the end

These sections continue after this agreement ends: section 7, for fees you owe; section 11, for as long as we hold your buyers' data; and sections 12 to 17, 19 and 20.

18. Changes to these terms

  • We may change these terms. We email you, and post the new version here, at least 30 days before a change takes effect. We tell you in plain words what changes.
  • If a law or a court requires a change sooner, we give you as much notice as we can.
  • If you don't agree to a change, you can delete your account before it takes effect. If you keep using the service after that date, the new terms apply to you.
  • A change never applies to anything that happened before it took effect.

19. Governing law and disputes

These terms, and any dispute arising out of or relating to them or the service, are governed by the laws of the jurisdiction where WearCheckout is established, without regard to conflict-of-laws rules. The courts there have exclusive jurisdiction. Either party may seek urgent injunctive relief in any competent court. If you are a consumer, you keep any mandatory protections of the law of the country where you live.

If you have a problem, please write to contact@wearcheckout.com first. We would like the chance to fix it.

20. General terms

  • Whole agreement. These terms, together with any Data Processing Addendum we both sign, are the whole agreement between us about the service. They replace anything said or written before. If a signed Data Processing Addendum conflicts with these terms on personal data, the addendum wins.
  • Transfer. You may not transfer this agreement without our written consent. We may transfer it, with notice to you, to a business that takes over WearCheckout or the service. That business must keep these terms, including section 13.
  • Events beyond control. Neither of us is liable for a delay or failure caused by events beyond reasonable control, such as failures of the internet, of power or of the services we depend on, natural disasters, war or government action. This doesn't excuse paying fees that are due.
  • Independent parties. These terms create no partnership, agency or employment between us.
  • No waiver. If either of us doesn't enforce a right at once, that right is not given up.
  • Severability. If a court finds part of these terms unenforceable, that part is enforced as far as the law allows, and the rest stays in force.
  • Third parties. Only you and we have rights under these terms, except the rights the Standard Contractual Clauses give to the people whose data they protect.
  • Notices. We send notices to your account's email address. You send notices to contact@wearcheckout.com. Agreements and notices made electronically meet any legal requirement for writing.
  • Language. These terms are written in English. If we translate them, the English version wins, unless the law of a consumer's home country says otherwise.

21. Accepting these terms

By creating an account, you agree to these terms. The sign-up page says so beside the button and links to them. If you don't agree, don't create an account.

We record which version of these terms you accepted and when. When you accept a new version, we record that too.
